Team One Media reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates any of these prohibitions, including but not limited to removing offensive content, suspending or terminating user accounts, and reporting such conduct to law enforcement authorities.

Intellectual Property Rights

All content on our platform, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the exclusive property of Team One Media or its content suppliers and is protected by international copyright laws. TO THE FULLEST EXTENT PERMITTED BY LAW, TEAM ONE MEDIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF TEAM ONE MEDIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL TEAM ONE MEDIA'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, CLAIMS, AND CAUSES OF ACTION ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE AMOUNT YOU HAVE PAID TO TEAM ONE MEDIA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

Disclaimer of Warranties

OUR SERVICES AND ALL CONTENT, MATERIALS, AND INFORMATION PROVIDED THROUGH OUR PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE.

TEAM ONE MEDIA DOES NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED OR THAT OUR SERVICES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF OUR SERVICES AND YOUR RELIANCE ON ANY INFORMATION, CONTENT, OR MATERIALS AVAILABLE THROUGH OUR PLATFORM. TO THE FULLEST EXTENT PERMITTED BY LAW, TEAM ONE MEDIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO OUR SERVICES.

Indemnification

You agree to indemnify, defend, and hold harmless Team One Media, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your use of our services; (ii) your violation of these Terms; (iii) your violation of any applicable law or regulation; or (iv) your infringement or violation of any third-party intellectual property rights.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in the defense of such claim at your own expense.

Termination

Team One Media reserves the right to terminate or suspend your account and access to our services at any time, for any reason or no reason, with or without notice or cause. Upon termination, your right to use our services will immediately cease. We are not liable to you or any third party for any termination of your account or access to our services.

Sections of these Terms that by their nature should survive termination, including but not limited to Intellectual Property Rights, Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law, shall survive the termination of these Terms and your use of our services.

Third-Party Links and Content

Our platform may contain links to third-party websites, applications, and services that are not operated by Team One Media. We are not responsible for the content, accuracy, legality, or any other aspect of third-party websites or services. Your use of third-party links is entirely at your own risk and subject to their terms and conditions and privacy policies.

We do not endorse, approve, or warrant any third-party content, products, or services. Team One Media shall not be liable for any damages or losses resulting from your use of third-party websites, applications, or services.

Governing Law and Jurisdiction

These Terms of Service and all matters arising out of or relating to your use of our services shall be governed by and construed in accordance with the laws of the jurisdiction in which Team One Media is incorporated, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of our services shall be brought exclusively in the courts located in the jurisdiction where Team One Media is incorporated, and you hereby consent to the personal jurisdiction and venue of such courts.

Additional Provisions

Waiver
